Stonehearth End User License Agreement

You receive the Stonehearth End User License Agreement (EULA)!

We’ll keep this brief. There are a few rules that go with acquiring and playing Stonehearth. Don’t break these rules, and you’ll be fine. They’re pretty simple.

So here’s the Legal Stuff.

This copy of Stonehearth (“the Game”) and accompanying documentation is licensed and not sold. This Software Product is protected by copyright laws and treaties, as well as laws and treaties related to other forms of intellectual property. Radiant Entertainment, Inc. or its subsidiaries, affiliates, and suppliers (“Radiant”) owns all intellectual property rights in the Game. The Licensee’s (“you” or “your”) license to download, use, copy, or change the Game is subject to these rights, to all applicable laws, and  to all the terms and conditions of this End User License Agreement (“Agreement”).

YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY DOWNLOADING THE GAME OR BY INSTALLING, USING, COPYING OR CHANGING THE GAME. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, YOU MUST NOT DOWNLOAD, INSTALL, USE, COPY OR CHANGE THE GAME.

And here’s what it means.

You paid money (or someone paid for you) so that you can play our Game – thank you! This purchase gives you a license to install, play, and use the Game on your personal computer. This permission is granted to you for your personal use only; you cannot sell or rent the Game, or sell or rent license keys for the Game.

We designed the Game to not only be played, but modified and customized. So you are welcome to create Mods and tools to enhance the game, and share these Mods freely with other players. You may not, however, sell or otherwise make money from the Game itself or from Mods, tools, or other enhancements created by yourself or others.

We have one clear rule regarding modifications or tools you may create: Mods or tools designed to exploit or grief, or interfere deliberately with other players’ enjoyment of the Game, are not allowed.

This is alpha software; it’s not done yet.

As of the date of this Agreement, the Game is what is known as “Alpha” software. This means that the Game is not complete; you may encounter errors or other issues that may interfere with gameplay. We hope that you will help us improve the game by providing feedback regarding bugs and issues you may find. Any feedback and suggestions you provide to us are contributed freely and with no obligation to you on our part to use or implement your input or to pay you for it.

You accept the software “as is” – that means that though we hope to make improvements, updates, and add new content to the Game, it is what it is, and we are not obligated to do so. The Game you have is the Game you play. Of course we plan to support, improve, and develop the Game going forward – we just can’t guarantee that we will.

Welcome to the sandbox!  Just follow the rules and use common sense.

As provided by this Agreement, you have a license to play the Game and make modifications for your own enjoyment (and to share with others). Radiant is the creator of the Game and is the owner of the Stonehearth brand as well as all content contained within the game. You may not incorporate, modify, or otherwise use the Stonehearth logo in any content, Mod, or tools you may create. The only exception to this is that you may use the Stonehearth logo as it appears on a game screen (e.g. the splash screen at the beginning of the game) in any video content you create (e.g., for YouTube or Twitch streams).

If you do create Mods or tools, those belong to you and you may do with them as you wish – although, as mentioned, you may not sell them or otherwise seek to commercialize (make money from) them.

Mods, tools, and other user-generated content are not created by Radiant, and we are not responsible for their quality or performance. Use of such content is at your own risk.

If you make any content available in or through our Game, including (but not limited to) buildings, building templates, items, and other content, you give us permission to use, copy, modify and adapt that content for any use, including in-game, on our website, and for marketing or other purposes. Your permission is irrevocable; if you do not want to give us such permission, please do not make content available in or through the Game.

Some last legal stuff.

This EULA is effective as of May 1, 2015. We reserve the right to make changes to this EULA at any time, and your continued use of the Game constitutes acceptance of the EULA as it may exist whenever you play or otherwise use the Game. This Agreement represents the complete agreement between you and Radiant concerning the Game, and replaces all prior agreements and understandings between you and Radiant regarding your use of the Game.  If a dispute involving your use of the Game arises, we agree to resolve it using California law.
